New York’s Legal Framework for Grandparents’ Rights

New York Domestic Relations Law §72 is the primary statute governing grandparents’ rights. It establishes the path for grandparents to petition either Westchester County Family Court or the New York Supreme Court for visitation or custody of a grandchild. The statute doesn’t create an automatic entitlement. A court must first find that the grandparent has standing, then separately determine whether the relief requested serves the child’s best interests.

New York courts give meaningful weight to a fit parent’s decisions about who spends time with their child. The U.S. Supreme Court addressed this tension in Troxel v. Granville (2000), which struck down Washington State’s broader non-parent visitation statute on constitutional grounds. New York courts have since continued to uphold DRL §72 as constitutional, distinguishing the more targeted New York framework from the statute reviewed in Troxel. Both biological grandparents and grandparents by adoption may petition under DRL §72; step-grandparents generally don’t have the same statutory path.

Establishing Standing Under DRL §72

Before a court will hear the merits of a grandparent’s petition, the grandparent must establish standing. There are two routes. If one or both parents have died, standing is automatic at this stage. No further showing is required before the court moves to the best-interests analysis.

When both parents are living, standing requires more. The grandparent must demonstrate either a substantial preexisting relationship with the grandchild or that the child’s parents have prevented them from forming or maintaining one. New York caselaw has recognized several circumstances that can satisfy this threshold: an extended period during which the grandchild resided with the grandparent while the parent voluntarily relinquished care and control, abandonment of parental responsibility, persistent neglect, or parental unfitness. A change in the parents’ legal relationship, such as divorce or separation, is also a recognized basis for a petition. Personal animosity between a grandparent and a parent, standing alone, isn’t enough to deny standing.

Visitation vs. Custody: Different Burdens, Different Standards

What a grandparent is asking for shapes how the court evaluates the case. Visitation and custody are legally distinct, and the burden of proof differs significantly between them.

Grandparents seeking visitation must show that regular contact would serve the child’s best interests. Courts weigh the nature and quality of the existing relationship, each party’s fitness, and the child’s own wishes if the child is old enough and mature enough to express a meaningful preference. When both parents object, courts apply additional scrutiny and may be less likely to override the parental decision unless the child’s welfare clearly requires it. The court may appoint an attorney for the child to independently represent the child’s interests in the proceeding.

Grandparents seeking custody face a higher burden. Under DRL §72, they must demonstrate “extraordinary circumstances”: a demanding legal threshold that courts have found satisfied by situations such as voluntary relinquishment of custody, abandonment, persistent neglect, or parental unfitness.

Grandparents’ Rights When a Grandchild Is in Foster Care

A grandchild’s placement in foster care doesn’t automatically end a grandparent’s right to seek contact. New York Family Court Act §1081 specifically addresses grandparents in this situation. A grandparent who already holds a court-ordered visitation right retains it when a grandchild is placed in foster care and may petition to enforce it against the foster care arrangement. Grandparents without an existing order who want contact with a grandchild in foster care should speak with an attorney about the available paths forward.

Grandparent Visitation After Adoption

Adoption complicates grandparents’ rights, but it doesn’t automatically end them in New York. The child’s best interests remain the guiding standard regardless of whether an adoption has occurred. Courts are more likely to consider grandparent visitation when the adoption is by a stepparent or another family member already within the child’s family network. When a child is adopted by unrelated third parties, courts give strong weight to the adoptive family’s privacy and stability, making visitation significantly harder to obtain. Each scenario is evaluated on its own facts, and grandparents shouldn’t assume their access rights have been extinguished without first speaking with an attorney.

How the Petition Process Works in Westchester County

A grandparents’ rights case begins with filing a petition in the New York county where the grandchild lives. For grandparents in White Plains, that means Westchester County Family Court or the Westchester County Supreme Court.

What the Petition Must Include

The petition must describe the basis for the request, the nature of the grandparent-grandchild relationship, any alleged interference by the parents, how visitation or custody would serve the child’s best interests, and a proposed schedule.

What Happens After Filing

Once filed, the court directs notice to all parties, including the child’s parents and anyone else who has filed for custody. The court may appoint an attorney for the child. A hearing is then scheduled, at which both sides present their positions. Grandparents should be prepared to submit affidavits, witness statements, and documentation of their history with the grandchild. Mediation may also be an option before or alongside litigation and can sometimes produce a negotiated arrangement without a contested hearing.
